On April 7, 2020, a new Federal Law was adopted that establishes the rules for the use of piggy banks (113-FL at 07.04.2020 “on amendments to the Federal law “On charitable activities and volunteerism”. The initiative came from representatives of the charitable community, including participants of the BS “All together”, charitable foundations, etc. This issue was first raised by representatives of major NGOs two years ago,when there was a surge in the activities of fraudsters masquerading as charity.
The amendments are necessary to fill a gap in the legislation: to fix the concept and types of donation boxes, prescribe requirements for their use, and increase the transparency of fundraising for charitable purposes. According to the law, only charitable organizations whose constituent documents provide for the right to carry out charitable activities can now use the piggy Bank box. The authorities, in turn, must prevent illegal and fraudulent Fund-raising activities. For example, using portable boxes on public transport is now completely illegal, and only charities can use them during events. At the same time, lawyers see difficulties in fulfilling the requirements of the law, since the CoAP and the Criminal code do not yet have rules that allow to classify illegal fundraising as fraud.
Law 113-FL should come into force in six months. It is hoped that the necessary amendments will be made by this time, and it will be easier to bring false creators to justice.
